Government Plans to Change the Process for Dealing with Drink Drive Offences

The press today features news that the Government is planning to change the procedure for dealing with drink-drive offenders.

It wants to remove the statutory right to a blood or urine test where a breath test reading is 50 microgrammes of breath or less, but above the legal limit of 35.

It is suggested that this creates a potential loophole which allows people to 'sober up' while they wait for a sample to be taken.

However in my experience this is not the case and appears to erode another long-standing legal right.
