How the Chancel Repair Liability Changes Will Affect You

Properties acquired before 12 October 2013 which are subject to chancel repair liability that is protected only as an overriding interest will remain so after that date until the next sale to a bona fide purchaser for value, as those properties were bought at a time when chancel repair liability was still an overriding interest. You will therefore still be at risk if you own an affected property.

Properties acquired after this date will not be subject to chancel repair liability, as long as the liability has not been noted on the Land Registry title to the property and as long as the buyer is a bona fide purchase for value.

If you get notification from the Land Registry of an application to note a chancel repair liability that you don't know about and agree, then get it checked carefully, and object if appropriate – promptly!
