Is A Driving Ban Inevitable When You Get 12 Points?

According to recently released figures by the DVLA,  there are in excess of 8,000 motorists in the UK who are still driving despite having accumulated 12 or more penalty points for traffic misdemeanours.

The reason for this is that a motorist, who would otherwise be disqualified for a minimum 6 months, would face “exceptional hardship” and  therefore is able to argue against a ban. The figures revealed that one unnamed motorist is still driving after accruing a total of 36 points!

It is also possible to appeal against a Magistrates’ court decision to refuse to find exceptional hardship and to suspend a disqualification.
