Re-drafted HSE Guidance Puts Workers At Risk

From October 2013 there will be a number of significant changes to health and safety legislation following Professor Löfstedt’s report, particularly for example the Workplace (Health, Safety & Welfare Regulations) the results of  which are said to be to “unburden” employers.

The HSE maintains that the redrafted new Approved Codes of Practice (ACOP) make it clearer and easier to understand.  Historically, they have provided guidance to employers to cover situations of risk, but as they now provide less detail, the risk now is that employers may misguidedly think that compliance with the regulations means they are “doing enough” and allow them to fall short of their previous requirements - actually leading to greater real risk/danger in the workplace and the level of protection to the worker is significantly reduced.
